No but he should be charged with whatever book they can throw at him here and whatever sentence he receives should be spent doing work in reparation for the undoubtedly serious damage he did. When you look at it another way though, he's a bit of a geek and needs a social life. Perhaps he could be employed by one of our agencies seeking out hackers and preventing computer fraud. He shouldn't be put in a cell, he needs help.
